1. This order is accepted subject to the prices in effect at the time of shipment.
2. Orders are not subject to cancellation or change without our approval.
3. No credit will be allowed for merchandise returned without our consent.
4. We are not bound by any printed matter on customer order blanks which impose upon us any conditions at variance with our regular terms and prices.
5. We are not responsible for non-delivery where such non-delivery is due to strikes or other labor difficulties, accident, fire, government controls and restrictions, unavailability of materials, delays of carriers or other delays which are unavoidable or beyond our control.
6. All goods are sold FOB shipping point. Title passes to the purchaser at the shipping point and our responsibility ceases with the delivery to the carrier.
7. We hereby certify that the above ordered goods will be produced in compliance with all applicable requirements of Sections 6, 7, and 12 of the Fair Labor Standards Act,as amended, and of regulations and orders of the United States Department of Labor issued under Section 14 thereof.
8. In the event the product is defective, we will replace it or refund purchase price. We are not responsible for the loss of profits, special damages, or other consequential damages resulting from defective product.
9. Claims for loss and damage due to shipping must be filed with the transportation company.
